Guide to nail 5 essential lies on Jammu and Kashmir

You are subjected to five essential lies on Jammu and Kashmir. Please use the below Primer if your teenage daughters, coffee friends or a stranger in transit try to shame you on celebrating the new status of Jammu and Kashmir. Who knows, inadvertently, you might be creating new foot soldiers to take on the Break-India forces and its stooge media. So here it is:

Abrogation of Article 370 is illegal:

Article 370 comes under part XXI of the Constitution of India which deals with “Temporary, Transitional and Special Provisions.”

Article 370 was not incorporated when Maharaja Hari Singh signed the instrument of accession on October 26-27, 1947.  It came a full two years later in October 1949 at the instance of Sheikh Abdullah, who was a member of the Constituent Assembly that drafted the Constitution.

Indeed, Article 370 became operative only in 1952.

So give a resounding kick in the butt to those who say that Jammu and Kashmir agreed to become a part of India only after it was assured the special protection of Article 370.

A bit of history won’t hurt you either.

India’s law minister, Dr. B.R.Ambedkar was firmly opposed to Article 370. This is what Dr. Ambedkar said to Sheikh Abdullah (as quoted in Dr. BR Ambedkar, Framing of Indian Constitution, by Dr S.N Busi):

“Mr Abdullah, you want India should protect your borders, she should build roads in your area, she should supply you food grains…but you don’t want India and any citizen of India to have any rights in Kashmir…To give consent to this proposal would be treacherous…I cannot betray the interests of my country.”

A full decade on, even Pt. Jawaharlal Nehru was conceding in Parliament on November 27, 1963: “Article 370 is part of certain transitional, provisional arrangements. It’s not a permanent part of the Constitution.”

Next year, a private member’s bill sought the abrogation of Article 370 in the Parliament. It received a near-unanimous support. Prakash Vir Shastri had moved the bill in the Lok Sabha. Among supporters were stalwarts like Ram Manohar Lohia and K. Hanumanthaiya, a senior Congress leader.

Hanumanthaiya had then pointed out that fellow MPs, irrespective of party affiliations, had wanted the abrogation of Article 370 to be made into law. He had said: “To go against or to anything against this unanimous opinion in this House is to disown constitutional responsibility in a convenient manner. Article 370…stands in the way of full integration.”

Out of the 12 MPs who opposed the abrogation of Article 370, seven were from Congress, many of them stalwarts, including Inder J. Malhotra, Sham Lal Saraf, HV Kamath and Bhagwat Jha Azad.

And by the way, how come abrogating Article 370 is illegal when the Bill wa passed by two-thirds in the Rajya Sabha and four-fifths in the Lok Sabha this month?

Who benefitted from Article 370? Obviously, the common people of J& K didn’t. The Shia community, Gujjars, Bakkarwals, Gaddis, other Scheduled Tribes, Scheduled castes and people living in Ladakh and Kargil didn’t.  Nor did Kashmiri women who made the mistake of marrying a non-resident and couldn’t purchase or transfer property to their children.

Now, with its abrogation, a total of 106 Central Laws will now be extended to J & K. A load of benefit schemes would come the way of local citizens. Prevention of Corruption Act, Land Acquisition Act, National Commission for Minorities Act, Right to Education Act etc would become applicable.

Why Not Remove Special Status of North-East States Too

This again is an argument forwarded by mischief-makers relying on your ignorance. Tell them that Article 371 (a) to (j) for North Eastern and other states are SPECIAL and not TEMPORARY provisions. That is to protect the development of a particular region for particular tribes. These being special provisions are permanent in nature. They are not temporary as Article 370 was in J & K.

Basic Rights to Kashmiris Are Being Denied:

Oh, Really?

Restrictions in the form of suspension of internet or even mobile services occur every year in the Valley on Independence Day, Republic Day and Eid for the last 30 years! Durations of these restrictions have been far longer in the past.

Do you know the extent of clampdown in the Valley when it suffered a long spell of violence in 2010? What were the conditions during the long spell of unrest during the Amarnath land agitation in 2008? Why was Farooq Abdullah government (before 1984) was termed as Curfew Government?

Between 1990-1996, the Valley remained under curfew on an average 300 days in a year! It was largely under Governor’s Rule between 1990-1996.

Was it not a clampdown in the Valley when Mobiles were introduced in India in 1990s but not in Jammu and Kashmir? (It came about only in 2003 under the Atal Behari Vajpayee government).

Why was there no outcry then?

Now let’s look at the ground conditions in Jammu and Kashmir at this very moment. Activist Rahul Pandita spent 10 days in the Valley after the abrogation of Article 370 and this is what he wrote in Times of India this Sunday:

“I went around in a small car with a local number. I had no curfew pass. There were barricades but security forces could be convinced to let go, as we did several times.

“District Commissioner Srinagar had issued 161 passes to local journalists (while you kept hearing on your TV sets that journalists were unable to go anywhere).

“On Eid (no less), the government took more than 60 journalists on a chopper ride over Srinagar. (Despite stringent restrictions, many reached their neighbourhood mosques).

“Security was totally removed from downtown Srinagar between 4-7 p.m. Boys came out, they painted a little graffiti, but they did not indulge in clashes (Hey, BBC and Reuters, read that).

“Spoke to cross-section, families of policemen, from Shia community and other silent ones who say they are ok with Article 370 abrogation.”

Political Arrests Are Unprecedented:

A reality check.

Sheikh Abdullah was in prison for more than a decade. And he wasn’t under house arrest like the present Valley leaders are. He was packed away to Kodaikanal not by Modi but by Pt. Nehru.

Shyama Prasad Mookerjee was kept under house arrest for 44 days without any chargesheet or FIR in Kashmir Valley. Have you heard of any outcry of human rights violations on Mookerjee?

And what’s the definition of these political leaders of Kashmir Valley who thrive on elections which see only a sample of 8-10 per cent voters’ turnout? It allows them to make it to the Lok Sabha, to the state assembly, to form state governments, generation after generation, to perpetuate their dynastic rule?

And if so upset by political detentions, shed a tear for those who are detained in Jammu too!

Demography would change; Kashmiri culture would vanish

Well, when lakhs of Kashmiri Pandits were driven out of Valley on gunpoint, the demography change didn’t matter to the champions of these pseudo-seculars.

(Ironically, when Assam is trying to weed out the outsiders to save the local, indigenous culture, these pseudo-seculars are in support of the infiltrators. So guys, make up your mind: You can’t be resisting outsiders in one state and supporting outsiders in another!).

Does Kashmiri culture imply that they remain in a state of poverty and unemployment generation after generation? Isn’t the aspiration of a largely young population—70 per cent are below 40— is for real? Don’t they know that every year, in the civil services exam, you have a topper or someone in the Top 20 from the Valley? That about 30-40 Class 12 pass-outs from terror-affected districts qualify in the IIT-JEE exams. That at least 50 people qualify for the NEET exam, the all-India entrance for medical colleges?

We can’t leave India to our politicians or professors

The smugness on Navjot Singh Sidhu’s face as if Messiah of peace between India and Pakistan, as he made way for Kartarpur across Wagah border, really got my goat up. Surely he knows Imran Khan is just a dummy; that terrorism both for Khalistan and Kashmir (or for Kabul) is our neighbour’s export, that for Vajpayee’s bus initiative we got Kargil. All this is not for India. This is to nurture his own constituency with an eye to be Punjab’s next chief minister. It would all suit Pakistan and Khalistan donors but not India.

But then why blame Sidhu? I read today Prime Minister Narendra Modi saying that Mamata, Akhilesh, Mayawati and Left are ok but not Congress. Mamata, for whom Durga Puja is not a priority and who equates BJP with Taliban; Akhilesh who sees BJP as the biggest danger to democracy; Mayawati who terms Modi as anti-poor; Left’s Sitaram Yechury who calls Modi as the looter of India, are all okay now. All this might win Modi elections. But what about India? What about millions of Hindus who see a threat in these forces and view Modi as their saviour?

Sonia and Rahul Gandhi are making overt gestures to be seen as essentially Hindus. They support the agitation against Supreme Court verdict on Sabrimala; have desisted in backing Sidhu on Kartarpur; Sonia sports a tilak (how ludicrous can it really get) in election rallies; and Rahul Gandhi shows his janau to everyone when none of his previous four generations ever wore it.  All this is for political dividends and certainly not India.

Shiv Sena are now agitated on Ram Mandir. Uddhav Thackeray and his army reached all the way to Ayodhya. Till recently, millions of workers from Uttar Pradesh and Bihar, most of whom are Hindus, were anathema to them. Now they can go thousands of miles to support a long-cherished dream of Hindus. The idea is to cut the plank which could help BJP in 2019 elections. Did you really think it was for Hindus or India?

Once in a while we are suffused with hope. Arvind Kejriwal was once such in 2014. He evoked Gandhi; wore muffler and slippers and took on the high and mighty of this land. Now he cartwheels around Mamata and Mayawati. He has made sure if another Kejriwal emerges he would have no chance of gaining people’s affection.  

But then who thinks for India? The ones who bring their garbage in the name of newspapers to our verandahs; the police or judiciary who give a damn to our urgency; the bureaucracy who are nothing better than glorified clerks afraid to put signature to anything meaningful; the NGOs most of whom are forward soldiers of foreign funders or the academia who trade pen for cheques?

Do you think you and I care about India? We would crib about thousands of issues in our air-conditioned rooms but never take that one step towards an agency. What did you last do about the filth in your neighourhood? Or the menace of wild dogs who could mount a concerted attack if you step out in pitched darkness? What do we personally do to reduce pollution or energy-usage? The horror that our schools are for our children? Taught by teachers who equate education with their salary slips? When did we last visit a village where 80 per cent of India still lives?

Politicians, media, judiciary, policy, bureaucracy, civil society and we as individuals are all too many words and too little action. It can’t work; it won’t work. India is stretching itself thin. Almost 18 per cent of world’s humanity is sitting on a volcano of lies and manipulation. The righteous impotence of me right vs.you wrong; your religion vs. my religion; those charlatans who take past quotes out of context and plaster the edit pages; the newspapers who pass on socialites and film actresses as our new Plato and Socrates. Writers have a role if they are impartial and neutral and appeal to reason or logic. Not when it is sold to someone else’s good. As readers we must take the pen out of their hands and give them shovels to dig their own graves.

Indians now need to be real stakeholders if India is to survive. We need to look at issues both personal and impersonal though the line is often blurred.  Personal would involve making our politicians, judiciary, police, media, bureaucracy accountable. Impersonal would mean larger issues such as those of farmers, joblessness etc.. We need citizens’ charters who audit our institutions like accounting firms do to their clients. We need to force our way into decisions our politicians take or the decisions our judiciary delays—for all other reasons except to the benefit of a common man.  We need to show them our anger is no longer limited to our drawing rooms. Trust me, we the faceless would have the attention of thousands of eyes and cameras if we stop them at their gates and demand an answer. Our inertia is our weakness and the only strength they have.

India can go wrong any moment. It could be an ecological disaster or a hostile nuclear-armed neighbourhood. It could be the lava of a largely young nation which frustrated at lack of jobs or coma of our judiciary could bury us all under a thick carpet of violence and breakdown. We surely can’t leave it to our politicians and professors.

No Gandhi but there could be many Godses

Nathuram Godse killed Mahatma Gandhi on 30th January 1948. We also know the provocation was Gandhi’s insistence to newly-formed Indian government that Pakistan be paid the obligated Rs.55 crores from the treasury.

Godse’s full statement in his trial was banned for 20 years till the Bombay High Court lifted it in 1968.  It bears a reminder now for both Hindus and Muslims lest a similar communal frenzy overtakes the nation in our lifetimes, abetted by forces who don’t have the interests of Muslims, certainly not of Hindus, and most definitely not of the nation we know as India.

Godse believed Muslims were appeased by Gandhi at the cost of Hindus. He cited several instances such as Khilafat Movement in the early 20s; the move to separate Sind from Bombay presidency in 1928; Mahatma’s “neither support nor opposition” to the Government of India Act of 1935 which allowed elections on communal lines and prepared the way for the horrific Partition; and the Great Calcutta Killingsand Noakhali Riots where lakhs of Hindu men and women paid with their lives and honour.

The Muslim League feared Hindu domination. Hinduphobia was built upon by Jinnah and other leaders of the Muslim League, abetted by British policy of “divide-and-rule.” Gandhi’s desire for a united front of Hindus and Muslims against British never materialized. His doctrine of Ahimsa didn’t work. It only caused rivers of blood to flow in front of his eyes. His turned out to be violent pacifism.

MODERN TIMES: Muslim viewpoint

Fast forward to modern times. Muslims perceive a hostile climate against their lives and food habits abetted by the central BJP government. They don’t stop to question:

(a)if BJP indeed is communal how come it doesn’t react to hundreds of Hindu killings in Kerala and Bengal? Why Advani’s Ayodhya’s rath-yatra was completely bloodless;

(b)How come its first act was to provide new subsidy to Islamic schools;

(c)If BJP indeed was fundmanetalist, how come the most strident Hindu voices such as Arun Shourie and Dr. Subramanium Swamy were never inducted in the Cabinet?

(d)Every time a stray voice, such as Sakshi Maharaj or Jyoti Niranjan go extreme, the government most vehemently come down on it;

HINDU VIEWPOINT

Hindus have their own grouse.

(a)Hindus pride in their religion is termed as “bigotry”;

(b)Hindus can’t come to terms with Ayodhya where Rajiv Gandhi himself had allowed Hindus to worship in 1986 and where all the eminent historians, such as Romila Thapar and Irfan Habib were shown to be manipulating history and archeology by the three-member jury;

(c)Hindus detest when their nose is rubbed on the ground on their cultural sensibility, such as “jallikattu”, “Durga Puja”, “Padmavati” among others;

(d)They feel helpless when the organized intelligentsia of this country (media, academia, Left-Liberals) deny them the platform to air their views. Their viewpoint is never represented;

Above all, Hindus feel that media/Left-Liberals/academics for too long have played the role of British “divide-and-rule” in this country. Fed by foreign money and preachers, missionaries of specific countries of monotheist religions such as Islam and Christianity, every effort is being made to make a pagan religion like Hinduism suffer, and if possible, to disappear.

Englightened Hindus feel aghast that their Muslim brethrens can’t look at the example of the Vajpayee government (1998-2004) and see through this game.

(a)These very same experts had predicted Hindu fascism and that “all Muslims into the Indian Ocean” under the Vajpayee regime;

(b)Despite the Kargil outrage in 1999, Vajpayee stopped the Army to strike across the border at invaders’ base;

(c)It was BJP which had thrown the Indian media market open to foreign media ownership despite the strident opposition by these very forces who today champion the idea of “freedom of speech.”

Hence, I propose a following manifesto for Hindus and Muslims for the safety of their future generations and unity of India (for god’s sake, how many divisions you want, you stupid):

(a)That we are different but we have lived in harmony in the past and we can live in harmony in present and future;

(b)That we would learn our historical lessons and wouldn’t allow India-breakers to play on our fault-lines;

(c)That we would see each other’s point of view on cow-slaughter, such as food habits and religious sensibility and accommodate each other strictly on the laws of the land;

(d)That Hindus would come forward on killings in the name of cow-vigilante and Muslims likewise would question the media’s narrative on Bengal and Kerala as well as constant attempt to denigrate our armed forces;

Above all, our religious moorings shouldn’t be allowed to override our concern for One India, One Unity. A Uniform Civil Code isn’t an attack on Shariat. And if it is, Muslims anyway submit to such rulings in France or Australia. The majority in this country has chosen BJP to lead India’s destiny till 2019 and we ought not to let our communal prejudice or bias interfere in its task.

And certainly not allow these India-breakers a field day. They are desperate and fast losing ground. Their propaganda has no effect on the electorates. India is a virtual heaven in modern comity of nations. Muslims are safer here than in any other non-Muslim country of the world. We shouldn’t become a pawn to a handful of India-breakers who are subsisted, funded and promoted by foreign forces.

Just remember: we can all wear our religious glasses but it must show the horrible future which our children would suffer in times to come.
